Article 1 - Purpose

These terms of use (the "Terms") set out the conditions of access to and use of the site https://silverbacksportwear.com/ (the "Site"), published by SilverBack, by any visitor or user (the "User").

Any use of the Site implies full and unreserved acceptance of these Terms. Users who do not accept them are asked not to use the Site.

The Terms apply to all browsing on the Site, independently of any purchase. Sales of products are governed by the terms of sale accessible on the Site.


Article 2 - Legal notices

The identity of the publisher of the Site and of its host appears in the legal notices accessible on the Site.


Article 3 - Access to the Site

The Site is accessible free of charge to any User with internet access. The costs relating to that access (equipment, connection) remain the User's responsibility.

SilverBack endeavours to keep the Site accessible at all times, without being able to guarantee uninterrupted availability. Access may be suspended, in particular for maintenance, updates or in the event of force majeure, without SilverBack incurring any liability.


Article 4 - User account

Users may browse the Site without creating an account. An account may nonetheless be offered to make ordering and order tracking easier.

When creating an account, the User undertakes to provide accurate information and to keep it up to date. The User is responsible for the confidentiality of their credentials and for all activity carried out from their account. In the event of unauthorised use, the User shall inform SilverBack without delay.

SilverBack reserves the right to suspend or delete an account in the event of a breach of these Terms.


Article 5 - User obligations

The User undertakes to use the Site in accordance with its intended purpose and with applicable regulations. In particular, the User shall refrain from:

  • impairing the operation, security or integrity of the Site;
  • accessing it fraudulently or introducing harmful elements into it (viruses, malicious code);
  • collecting data relating to other Users without authorisation;
  • using the Site for unlawful or fraudulent purposes, or in a way that infringes the rights of third parties.

Any abusive use may result in suspension of access and, where applicable, legal proceedings.


Article 6 - Intellectual property

All the elements of the Site (SilverBack brand, logo, texts, visuals, photographs, graphic elements, structure and code) are protected by intellectual property law and remain the exclusive property of SilverBack or its partners.

Any reproduction, representation, modification, publication or adaptation, in whole or in part, of any one of these elements, without prior written authorisation from SilverBack, is prohibited and liable to constitute infringement.


Article 7 - Content submitted by Users

Users who publish content on the Site (reviews, comments) warrant that they hold the rights to it and that the content is lawful. They shall refrain from any unlawful, defamatory or misleading content, or content that infringes the rights of third parties. SilverBack reserves the right to remove any content contrary to these Terms or to the law. Published reviews reflect the opinions of their authors.

 

Article 8 - Personal data and cookies

The processing of personal data is described in the Privacy Policy. The use of cookies and trackers is described in the cookie policy. Both documents are accessible on the Site.

 

Article 9 - Hypertext links

The Site may contain links to third-party sites. SilverBack exercises no control over those sites and accepts no liability for their content or their use. Creating a link to the Site is subject to SilverBack's prior agreement.

 

Article 10 - Liability

SilverBack does everything possible to provide accurate and up-to-date information, without guaranteeing the complete absence of errors or omissions. The information appearing on the Site is provided for guidance only and may change.

SilverBack cannot be held liable for:

  • damage resulting from access to or use of the Site, including unavailability, the presence of viruses or technical faults;
  • the use made by the User of the information and content on the Site.

These provisions do not limit SilverBack's liability in cases where the law prohibits such limitation.

 

Article 11 - Amendment of the Terms

SilverBack reserves the right to amend these Terms at any time. The applicable Terms are those in force at the time of browsing. Users are invited to consult them regularly.

 

Article 12 - Applicable law and disputes

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the dispute falls within the jurisdiction of the competent courts in accordance with ordinary rules of law, with the protective provisions applicable to consumers remaining reserved.
